According to a recent email I received, the following attached case from the Appellate Court sided with MH and said judges cannot outsource their judicial authority and discretion to third parties regarding a parent’s court ordered parenting time. i.e. A judge can’t order or allow a parent, therapist and/or GAL to decide or dictate how much parenting time the other parent enjoys or does not enjoy (based on the parent’s actions.) But rather, the judge must issue clear and consistent parenting orders which can be challenged, but not alteredby these third parties without a hearing and/or subsequent order of the court. Because this is an appellate case, it might be usable in other states as it is an appealed case in federal state court. Please contact us for a copy of this decision. (fb)
