During the year the Association paid covered claims on behalf of insolvent insurers in accordance with the state statute, Chapter 16 of Title 38.2 of the Code of Virginia.

Virginia Property and Casualty Insurance Guaranty Association

The Virginia Property and Casualty Insurance Guaranty Association (VAPCIGA) is a nonprofit, state-based organization that acts as a safety net for policyholders and claimants in the event that a licensed property and casualty insurance company in Virginia becomes insolvent. Established as part of Virginia's regulatory framework for insurance, VAPCIGA ensures that certain claims are paid up to the limits set by the policy or applicable law, providing financial stability to consumers when they need it most.

Purpose and Administration

VAPCIGA's primary role is to minimize financial hardship to policyholders and claimants by paying covered claims that exist prior to the insurance company's insolvency. It focuses on protecting consumers from financial loss when an insurance company fails to meet its obligations due to insolvency.

The organization functions as a member-based system; all property and casualty insurance companies licensed to operate in Virginia must be part of VAPCIGA as a condition of their licensure. This framework ensures widespread protection across various lines of insurance, including automobile, homeowners, workers' compensation, and other types of property and casualty insurance.

Funding and Operational Structure

VAPCIGA is funded mainly through assessments on its member insurers, distributions from insolvent insurers' estates, and investment income. These assessments are calculated based on each member's net direct written premiums from the preceding year. The organization operates with a board of directors responsible for managing its activities and making key decisions regarding claim handling and financial management.

Covered Claims and Exclusions

While VAPCIGA provides coverage for a wide range of property and casualty insurance policies, certain types of insurance are not covered. These exclusions include:

  • Life, annuity, health, or disability insurance.
  • Mortgage guaranty, financial guaranty, or other forms of insurance offering protection against investment risks.
  • Fidelity or surety bonds or any other bonding obligations.
  • Credit insurance, credit property insurance, and credit involuntary unemployment insurance.
  • Insurance of warranties or service contracts.
  • Title insurance.
  • Insurance of vessels or craft used primarily in a trade or business.
Claim Payment Process

VAPCIGA begins paying claims following a court order declaring an insurance company insolvent. It handles claims directly or through servicing facilities approved by the Virginia Bureau of Insurance. Claimants must have been residents of Virginia at the time of the insured event or have property permanently located in the state to qualify for coverage.

Legal Framework

VAPCIGA operates under the provisions of Virginia Code Ann. §38.2-1600, et seq., which outlines its powers, duties, and structure. This legal framework ensures that VAPCIGA acts to protect consumers while maintaining a stable insurance market in Virginia.

Similar Organizations

In addition to VAPCIGA, the Virginia Life, Accident & Sickness Insurance Guaranty Association provides similar protections for life, health, and annuity insurance policyholders. Both organizations play critical roles in maintaining consumer confidence and financial stability in the insurance sector.
