For far too long, protections for abortion have been allowed through regulatory statutes implemented by the Biden administration. These harmful regulations included: 1) a CMS (Centers for Medicare & Medicaid Services) memo interpreting EMTALA (Emergency Medical Treatment and Active Labor Act) to mandate abortions in certain emergencies, which contradicts the statute’s text and violates the major questions doctrine. 2) an OLC (Office of Legal Counsel) memo nullifying Comstock Act mail-order abortion restrictions, which misreads the law and undermines federal pro-life policy. 3) an EEOC (Equal Employment Opportunity Commission) rule under the Pregnant Workers Fairness Act (PWFA) that includes abortion as a protected condition, which exceeds statutory authority and conflicts with the Act’s intent to support healthy pregnancies and childbirth.
