The Trump Administration is claiming that states and cities (including in RI) are violating the law by not holding people for ICE after they issue an administrative detainer, when the opposite is true. Detaining people for ICE based solely on this non-judicial request can often violate the Constitution. 🌊 The ever-present RI connection: It was a RI court decision (Morales v. Chadbourne) that Homeland Security claims makes RI a sanctuary state! In 2012, we represented a North Providence resident & U.S. citizen who was wrongly held at the ACI *twice* by ICE based on erroneous detainers. The judge ruled that the Fourth Amendment (protection from unreasonable searches/seizures) does not permit the government to hold someone based merely on an ICE detainer to investigate their immigration status.
