Throughout our country’s history, we have been faced with some of the most anti-immigrant political projects waged against a host of foreign-born people – from the Chinese Exclusion Act to the so-called “zero tolerance” family separation policy at the southern border. Many of the country’s cruelest immigration laws and enforcement practices not only stemmed across party lines but also went beyond the border, with anti-immigrant sentiment seeping into decisions about social safety net programs, local law enforcement, disenfranchisement, and individual state lawmaking. White supremacy and other baseless conspiracy theories have been the thread with which such projects have been sewn and justice advocates across diverse communities have fought these measures each time, often relying on our representative democracy’s federal legal system and constitutionally guaranteed freedom of speech. Today, we are entering an uncharted and dangerous arena – one in which the State’s attacks on such tools of democracy are making them less viable and more precarious. This administration is operating with new and old tools of incrementally normalized fascism many historians are warning about: Tech-fueled mass surveillance, foreign torture prisons, border military camps, erasure of due process, defiance of court orders, prosecution of judges who apply checks to their power, persecution for political dissent, attacks on established law on sanctuary, and the privatization schemes of mass incarceration. If we allow our checks and balances to topple, we may soon find fundamental rights and equal protection under the law for ALL Americans are things of the past. Push back by helping your immigrant neighbors, friends, and family know their rights.
