In the News 📰 Professor Susan Bisom-Rapp was quoted in an article published by Bloomberg Law's Daily Labor Report on May 20th. The article, "States Caught in Crosshairs of Biden-Era Worker Inspection Suit," discusses efforts by the National Association of Manufacturers (NAM) and the Chamber of Commerce to eliminate a Biden-era Occupational Safety and Health Administration (OSHA) Rule called the "Walk-Around Rule." Effective May 31, 2024, OSHA's rule specifies that OSHA inspectors may take along a third party designated by employees when they inspect a workplace. That third party may be anyone deemed by the inspector to be reasonably necessary to assist the inspection, including union representatives or lawyers even where those third parties are not employed by the company. The rule, which has been challenged in federal court by business groups, will not necessarily be defended by OSHA now that the agency's leaders are members of the Trump administration. Additionally, last month, NAM wrote to the Trump administration's new Secretary of Labor Lori Chavez-DeRemer asking that OSHA rescind the rule. Professor Bisom-Rapp opined that "This is an easy rule for [the Trump administration] to rescind." Additionally, she noted that she thought it unlikely that the Trump administration's OSHA would expend resources defending the rule in court. Finally, she noted that states which have adopted their own versions of the Walk-Around Rule might face suit if the federal rule is rescinded or OSHA settles the federal lawsuit, and the states insist on standing by their own Walk-Around Rules.
