The 2025 legislative session of the Nebraska Unicameral officially adjourns sine die today. Since January, our senators have tackled a range of issues impacting health care in our state, from taking on Big PhRMA to protect the 340B program to critical budget appropriations for the Rural Loan Repayment Program. Through countless hours of committee hearings and floor debates, this year saw important strides in reforming prior authorization and PBM practices. We are grateful for the efforts of every Nebraska senator, and the dedication and advocacy of our members. Together we will continue our work to improve health care for every patient in our state. 🚨Key Vote Alert!🚨 Today, the Ensuring Transparency in Prior Authorization Act (LB 77) passed on Final Reading. The Ensuring Transparency in Prior Authorization Act seeks to streamline processes and increase transparency and accountability by: ⏺️ Requiring prior authorization rules to be publicly available online and mandating 60 days’ notice for any changes. ⏺️ Standardizing the process by implementing a universal form to streamline prior authorization submissions. ⏺️ Ensuring physician oversight by requiring that denials and peer-to-peer reviews be conducted by a licensed physician of the same or similar specialty; AI alone cannot be used to deny care. ⏺️ Mandating timely responses from insurers, with automatic approval if those deadlines are not met. ⏺️ Prohibiting retroactive denials for care delivered within 60 days of prior authorization approval. ⏺️ Guaranteeing continuity of care by keeping prior authorizations valid for at least one year and allowing them to transfer with patients for 60 days when changing insurance plans; inpatient approvals must cover the full stay. ⏺️ Eliminating prior authorization requirements for emergency care, preventive services, and routine immunizations.
