Action Needed: Contact Your State Senators TODAY! 📢 Issue: HB 61 Ask: Vote NO in the Senate Rules Committee! Section 5 of HB 61 deals with extended stay hotel residents and provides that upon the person’s failure to pay the hotel fee (or the hotel’s refusal to accept payment) they can be immediately denied access to the room, their personal property seized and held until any past due fees are paid, and law enforcement may be summoned to arrest them if they do not immediately vacate the property. Law enforcement is denied any discretion. No notice to the resident is provided, nor any opportunity for due process. It further provides that a resident is presumed to be a guestregardless of duration of stay or frequency or method of payment, and in order to convert the relationship into a landlord-tenant relationship, a formal written lease is required. HB 61 harms long-term extended stay hotel residents, many of whom are low-income families just one step away from homelessness. These residents often can’t access traditional housing due to poor credit, lack of savings, or past evictions. Over 9,000 Georgia children lived in extended stay hotels last school year—a number that’s rising.
